ENVIRONMENTAL SANITATION EDICT: 
This law exists in many states of the federation with small/short change in title. However, they have common (legal rules). These include (the creation of/the beginning of the existence of) bodies for (related to surrounding conditions or the health of the Earth) (keeping things clean and disease-free) and the prescription of (related to surrounding conditions or the health of the Earth) offences and penalties. It covers such issues relating to (keeping things clean and disease-free) as waste disposal, industrial and commercial pollution etc.

The involvement with crime of waste management by some private contractors in Rivers State calls for sober reflection. This is because, the rate of dangerous carelessness by which some of the contractors search (for dead or missing things) for pit (burrow pit) without (thinking about/when one thinks about) its closeness to (where there are lots of homes) area, calls for extremely important attention. This calm and easygoing behavior is openly/obviously showed from the collection and at dumping centers. They often use their trucks to block roads on the way to waste dumps; the overloaded trucks (trash or other things on the ground) our roads with waste materials. And at dumping places/locations, most of these pits are very close to roads and our highways. A case (nearby/ close/ currently important) is one at Rukpokwu along the road to Eneka in Obio/Akpor L.G.A.

Our roads that are begging for attention have been worsened by the activities of the refuse contractor. The Rukpokwu/Eneka road is one of the few roads in Rivers State that is manageable but today, it is better described as death trap as a result of (something shocking that got everyone talking) acts of rubbish contractors. The trip from Rukpokwu (connecting point/joining point) to Eneka first market (connecting point/joining point) used to be between four and six minutes, it's now between one and two hours. Taxi drivers and other users of the road are in better position to narrate their struggle. If it any course you decide to take a trip through that route, you will be greeted with powerful, nasty odor that stinks out from nauseating heap of rubbish, even passing along that road can cause one to repeat/vomit. Oh, residents of the (next to) place are the most terrible (and very unhappy). 

(the health of the Earth/the surrounding conditions) is carefully thought about/believed (dirty/containing unwanted things) when it is changed in composition or condition directly or indirectly as a result of the activities of man, so that it becomes less good for some or all of the uses for which it is good in its natural state. The health effects/results/suggestions of pollution in (community of people/all good people in the world) are very obvious because (related to surrounding conditions or the health of the Earth) pollution destroy the physical, mental and social well being of man. Lung sicknesses are contracted from inhaled dust, skin sicknesses from poisonous wastes released into the atmosphere.

There is yet a well-thought-out effect on the human body which happens when a poisonous substance has been soaked up (like a towel) into the blood stream and distributed throughout the body. Disturbances may be caused in (more than two, but not a lot of) parts of the body such as blood, nervous system, (organ that creates urine), liver and skin. The harmful effects of land pollution can never be over drew attention to. The contamination of land not only affects the natural surrounding conditions on the earth but also affects the quality and (healthy and good character) of underground water. It is no more news that- the state, especially city-based residents depend on borehole for their drinking water. The future predicts danger of widespread disease; that's the reason for the (surrounding conditions) that is already (add unwanted things to/make dirty)d is worsened by the inland water that forms the only source of borehole within the area. Protection of human life is going to be treated as more important than everything else in our (community of people/all good people in the world).

(related to surrounding conditions or the health of the Earth) pollution is a violation of human rights. From a legal point of view, pollution is the wrongful contamination of the atmosphere or water, or of soil to the material injury or damage to the rights or property of people. (related to surrounding conditions or the health of the Earth) pollution is a failure (or break) of man's right o live in a clean and healthy (surrounding conditions).


The African charter on human and people's right 1981 links right to (surrounding conditions) and development Article 22 states that: All people will have the right to a general acceptable (surrounding conditions) good/willing to there development and states will have the duty, individually or all together to secure/make sure of its exercises of the right to development".


The point at which a particular activity changes (the health of the Earth/the surrounding conditions) and totally affects the way of life and money-based well being of those who live within its area, or presents/causes danger to their health and life is the (dividing line/point where something begins or changes) at which the right to a clean (surrounding conditions) is broken relating to surrounding conditions or the health of the Earth) pollution make up/be equal to the offence or tort of annoyance which means "an illegal interference with the use and enjoyment of land or property, or some right over, or in connection with it" as well as criminal offence - section 234 of the criminal code CAP C. 38 laws of the federation. In as much as it is the duty of government through the office of the Lawyer General of the federation of the state as the case may be, as was clearly said in the case of Amos V. Shell B.P. (Nigeria) Ltd (1974) 4. E.C.S.L.R 486 at P. 488. However, as far back as 1979, the strict measure was removed by section 6 (6) (b) of the 1979 constitution. And decision in Adediran V. Interland Transport Ltd. (1991) 9, NWIR, part 9 (214) P. 115 put a final stop to whatever (blocking thing) weighing heavily against private suit to the strong desire/formal decision about something of any famous/highly complimented violation to right.

Not prevented by/not part of the issue, non-justiceable (legal rules/food and supplies) of S14 (2) (b) and 20 of 1999 constitution of the Federal Republic, of Nigeria, IP-SO Facto, it is the first (or most important) responsibility of the state to safeguard, protect and improve our (surrounding conditions) through whatever means as contained in Article 22 of African Charter on human and people's right 1981. It is (person who's currently an elected official) to speed up action to save the people of careless dumping of refuse so as not to endanger lives and also (act to prevent problems before they happen) to waste management in the state.

While Diobu in Port Harcourt is a way of thinking to long list of new interest (or popularity)s being saw on daily basis within and around the big city, government should check the activities of the waste management contractors through the ministry of (surrounding conditions) by making sure that they obey the (legal rules/food and supplies) and terms o their contract. The dumping places/locations should be examined before approval is given. It is trueor that level of poorness is multiplying by the day yet one should first think about/believe the hint/result/effect and bad after-effects of collecting peanuts from the contractors in the name of selling the pit while troubles become their lot. The idea/belief of strict (something you owe/something you're responsible for/disadvantage) proposed by Blackburn in Ray land V. Fletcher (1868) LR 3, HC 330, can be called for/used.

Rivers state government especially under this management has invested and is still investing much to the wellbeing o f the group of citizens especially to health and educational parts/areas to improve the lives of her people. As the saying goes, a healthy nation is a rich nation, it will be wrong and shocking and disgusting for anyone or (service business/government unit/power/functioning) to frustrate and irritate of form a coat to the progress so far (accomplished or gained with effort).

Those that won the contract of disposing the unwanted materials should be careful in their lawful activities. The law does not wink at any smallest irresponsibility in the exercise of lawful duty. Against this background, the statement of Lord Atkins in Donoghue V. Stevenson (1932) AC. 502 is very (teaches things) as he (in a well-said way) puts it.

The rule that you are to love your neigbour becomes in law; you must not hurt your neigbour... So where duty of care is owned, extreme care should be maintained as everyone is in danger of being lost to the cause of keeping the state clean.
